Using this Website indicates that you accept these terms regardless of whether or not you choose to register with us or order from us. 1. IN THESE CONDITIONS:
"Designed in England" has the following website addresses: www.designedinengland.com and www.designedinengland.co.uk ("the Website").
"Your Order" means orders placed by you using the ordering process as set out on our Website."Goods" means those products made available by Designed in England that you wish to purchase, as indicated in your Order.
2. INTRODUCTION
2.1 You will be able to access most areas of this Website without registering your details with us.
2.2 We may revise these Terms and Conditions at any time by updating this posting. You should check this Website from time to time to review the then current Terms and Conditions, because they are binding on you. Certain provisions of these Terms and Conditions may be superseded by expressly designated legal notices or terms located on particular pages of this Website. If you do not wish to accept any new Terms and Conditions after we have given notice, you should not continue to use this Website.
3. CUSTOMER OBLIGATIONS
By submitting your Order you warrant that you are the authorised holder of any credit/debit card you may use on this Website.
4. ORDERING FROM US
4.1 You are deemed to place an order with us by ordering via our online checkout process which is hosted by Paypal. Paypal will send you an order acknowledgement, detailing the products you have ordered..
4.2 We may refuse to accept an order:
(a) where we cannot obtain authorisation for your payment;(b) if there has been a pricing or product description error;(c) if you do not meet any eligibility criteria set out in our Terms and Conditions (d) where Goods are not available at that time.
5. LIMITATIONS OF SUPPLY
5.1 Designed in England shall make every effort to ensure that all orders are fulfilled, however we cannot guarantee the availability of all Goods at all times.
5.2 In the event of Goods being unavailable, a member of our staff shall contact you by email or telephone and we may at our sole discretion, provide replacement Goods of an equivalent value, quality and/or specification or a full refund, subject always to your right to reject the Goods.
6. PRICING AND PAYMENT
6.1 All prices include VAT (where applicable) at the current rates and are correct at the time of entering information. Please note that currencies other than GBP sterling (£) are shown as a guideline only and the exact price may vary slightly depending on each day's exchange rate. You will be charged for your purchase in Pounds Sterling.
6.2 We reserve the right to alter prices without notice. Customers who have already ordered before any such change may at our absolute discretion have their order fulfilled at the price appertaining to the order date.
6.3 Where we charge separately for packaging and delivery, the appropriate rates are set out in our specified pricing structure explained in Clause 7.1.
6.4 We must receive payment of the whole of the price for the Goods that you order before your Order can be accepted. Once payment has been received by us we will confirm that your Order has been received by sending an email to you at the email address you provide us with when you place your Order.
6.5 Paypal accept only the following forms of payment for online purchases:

6.6 We do not accept cheques (cashier or personal) or money orders as valid forms of payment.
6.7 Orders will be processed once we have received payment authorisation.
7. DELIVERY AND CARRIAGE
7.1 Our delivery charges (for mainland UK) are free for orders £5 and under and £300 and over. There is a charge of £3.50 for orders over £5 and under £15, £4.50 for orders between £15 and £50 and a £6.00 charge for orders between £50 and £300.
7.2 Our terms state that delivery can be up to 28 days. However, our aim is to deliver within 14 days, subject to the availability of the items.
7.3 We will deliver the Goods to the address you specify for delivery in your Order. It is important that this address is accurate. Please be precise about where you would like the Goods left if you are out when we deliver by writing an email to us at info@designedinengland.com. We cannot accept any liability for any loss or damage to the Goods once they have been delivered in accordance with your delivery instructions (unless this is caused by our negligence). We will aim to deliver the Goods by the date quoted for delivery but delivery times are not guaranteed. If delivery is delayed due to any cause beyond our reasonable control, the delivery date will be extended by a reasonable period.
7.4 Upon delivery of the Goods you must carefully inspect them. If any of the Goods do not match the description or appear to be damaged or are missing, do not use the Goods and please contact us immediately by email to inform us of the problem. We will then advise you as to how to proceed.
8. TRANSFER OF RISK AND OWNERSHIP
8.1 You will become the owner of the Goods you have ordered when they have been delivered and acknowledged by you (or a member of your household who is authorised by you to accept the Goods) and receipt of full payment by us.
8.2 Once Goods have been delivered to you they will be held at your own risk and we will not be liable for their loss or destruction.
8.3 In the event of cancellation, risk remains with you until the Goods are received by Designed in England.
8.4 Goods supplied are not for resale unless purchased through our TRADE account
9. CANCELLATION / RETURNS POLICY
Our wish is to ensure your complete satisfaction. The name of Designed in England stands for excellent quality and customer satisfaction which are attributes seen in everything we do. We trust you will be entirely satisfied with your purchase. If for any reason you are not, please do not hesitate to contact us.
9.1 If you wish to cancel your Order:
(a) you can notify us by email before we have dispatched the Goods to you; or (b) where Goods have already been dispatched to you, by contacting us by email within 24 hours upon receipt of goods and a suitable return schedule will be arranged.
9.2 The costs of returning Goods to us shall be borne by you unless there is a defect in the Goods.
9.3 Providing that all Goods are returned in substantially the same condition as when received by you, we will either replace such Goods or offer a credit note to you. In the event that goods are damaged or soiled please contact us as outlined in 9.1
10. ACCURACY OF CONTENT
10.1 We have taken care in the preparation of the content of this Website, in particular to ensure that prices quoted are correct at the time of publishing. However, orders will only be accepted if there are no material errors in the description of the Goods or their prices as advertised on this Website.
10.2 Please note that any dimensions given about the Goods are approximate only and photographs may not match exactly the product with respect to the colour.

14. LIABILITY
14.1 If you do not receive Goods ordered by you within 28 days of the date on which you ordered them, we will have no liability to you unless you notify us in writing (by email or post) of the problem within 30 days of the date on which you ordered the Goods (unless this is not reasonably practicable). If you notify a problem to us under this condition, our only obligation will be, at your option:
(a) to make good any shortage or non-delivery; or(b) to refund to you the amount paid by you for the Goods in question in whatever way we choose.
14.2 You must observe and comply with all applicable regulations and legislation, including obtaining all necessary customs, import or other permits to purchase Goods from this Website. The importation or exportation of certain of our Goods to you may be prohibited by certain national laws. We make no representation and accept no liability in respect of the export or import of the Goods you purchase.
14.3 We try to ensure that this Website is free from viruses or defects. 14.8 We accept no liability in respect of any non-standard use of the Goods such as, by way of example only, placing non dishwasher safe objects into a dishwasher.
15. GOVERNING LAW AND JURISDICTION
15.1 These Terms and Conditions shall be governed by and construed in accordance with English law. Disputes arising in connection with these Terms and Conditions shall be subject to the exclusive jurisdiction of the English courts.
15.2 We do not warrant that Goods for sale on the Website are appropriate or available for use outside the United Kingdom. It is prohibited to access the Website from territories where its contents are illegal or unlawful. If you access this Website from locations outside the United Kingdom, you do so at your own risk and you are responsible for compliance with local laws.
16. FORCE MAJEURE
16.1 We shall be entitled to suspend or withhold deliveries of Goods in the event of any delay or stoppage howsoever caused including any strike, mechanical breakdown, act of God, any hostile action or any other cause beyond the Company's control and the Company shall not be liable for any loss, expense or damages whatsoever suffered by the buyer as a consequence of any such delay.
17. THIRD PARTY RIGHTS
17.1 Nothing in this Agreement is intended to, nor shall it confer any rights on a third party.
18. OTHER PROVISIONS
18.1 You may not assign, sub-license or otherwise transfer any of your rights under these Terms and Conditions.
18.2 If any provision of these Terms and Conditions is found by any court of competent jurisdiction to be invalid, the invalidity of that provision will not affect the validity of the remaining provisions which shall continue to have full force and effect.
